This Criminal Petition, under Section 438 of the Code of Criminal Procedure, 1973, is filed by petitioner-accused seeking to grant anticipatory bail in Crime No.68 of 2019 on the file of Annasagar Police Station, Mahaboobnagar District, registered for the offences under Sections 420 and 487 lPC.

Heard learned counsel for the petitioner, learned Additional Public Prosecutor representing the respondent-State and perused the record.

3. lt is alleged in the complaint that on 12.06.2019 at 16.00 hours, on credible information from the enforcement department, the Mandal Agricultural Officer along with his staff visited a shop, namely, Gopikrishna Seeds, situated at Door No.4-485, Bhoothpur, and on inspection, they found 95 empty seed pouches. They also visited another shop, namely, Shanthi Seeds, situated at Door No.74512 and found 4 DCS in which he was sending empty pouches to Kurnool and some other places. Earlier, as the Proprietor of the shops was possessing empty seed pouches with fake labels, his license was suspended on 03.07.2017 vide proceedings No.SR Cell(2) 32012017.

Learned counsel for the petitioner/accused submits that the \ I petitioner never involved in any crime as alleged and that a false case has been foisted against him. He further submits that as the petitioner is a permanent resident of Bhoothpur Village of Mahabubnagar District, having fixed abode and landed property, the question of his absconding does not arise. He further submits that ./'

the entire investigation is completed except filing of the charge sheet. He further submits that the petitioner is only the earning member of his family and he shall abide by any condition imposed by this Court.

Learned Additional Public Prosecutor vehemently opposed to grant anticipatory bail to the petitioner.

ln view of the nature of allegations leveled against the petitioner and other facts and circumstances, without adverting to the merits of the matter, I am inclined to grant anticipatory bail to the petitioner/accused with certain conditions.

Accordingly, the Criminal Petition is allowed and the petitioner/accused is directed to surrender before the Station House Officer, Annasagar Police Station, Mahabuubnagar District, within a period of 15 days from the date of this order. On such surrender, the said Station House Officer shall release the petitioner/accused on bail on his executing a personal bond for a sum of Rs.15,000/- (Rupees fifteen thousand only) with two sureties for a like sum each to his satisfaction. On such release, the petitioner/accused shall abide by the conditions stipulated in Section 438(2) Cr.P.C and cooperate with the investigating officer in investigating the case. 8.

As a sequel, miscellaneous applications, if any pending, shall I stand closed.
