HON'BLE SRI JUSTICE T.SUNIL CHOWDARY WRIT PETITION No.23020 OF 2016 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking a writ of Mandamus declaring the action of the respondents in taking the canal through the house site plots of the petitioners bearing Plot Nos.15, 54, 53, 19, 55, 17, 13, 14, 22 and 56 situated in Sy.Nos.2213, 2214 and 100 of North Addanki Village, Addanki Mandal, Prakasham District as illegal, arbitrary and violative of Articles 14, 21 and 300-A of the Constitution of India and consequently restrain the respondents from laying the canal through the properties of the petitioners.

2. Heard the learned counsel for the petitioner and learned Assistant Government Pleaders for Irrigation and Command Area Development (A.P.).

3. The learned Assistant Government Pleader, on instructions, submitted that there is no proposal for construction of the canal as pleaded by the petitioners. The submission is recorded. In view of the submission made by the learned Assistant Government Pleader, no further orders are necessary in this writ petition.
