HON'BLE SRI JUSTICE T.SUNIL CHOWDARY WRIT PETITION No.26375 of 2016 ORDER:
1 This writ petition is filed under Article 226 of the Constitution of India seeking a writ of Mandamus declaring the inaction of the respondent Nos.2 and 3 in considering the representation of the first petitioner dated 03.11.2015 as illegal and arbitrary.
2 Heard the learned counsel for the petitioner and the learned Government Pleader for Forests.
3 A perusal of the record reveals that the first petitioner started a saw mill in the name and style of Sri Shirdi Sai Saw Mill and Timber at Ponuganti Valasa village, Santhakavit Mandal of Srikakulam District with
(1) Two Band Saws - 10 H.P. each and (2) Two Horizontal Saws - 15 H.P. each. The second petitioner is intending to shift a part of the machinery of the saw mill to Burada village, Ragadi Amudalavalasa Mandal, Srikakulam District for the purpose of establishing another saw mill there. The petitioners submitted a representation to the respondent Nos.2 and 3 on 03.11.2015, but, the respondent Nos.2 and 3 have not passed any orders on the representation submitted by the petitioners. 4 The only relief sought by the petitioners is to direct the respondent Nos.2 and 3 to consider their representation dated 03.11.2015 and pass appropriate orders thereon.
5 Having regard to the facts and circumstances of the case, the respondent Nos.2 and 3 are hereby directed to dispose of the representation dated 03.11.2015 submitted by the petitioners in the light of G.O.Ms.No.91, Environment, Forests, Science & Technology (For.III) Department, dated 11.07.2006 as expeditiously as possible, preferably, within a period of one month from the date of receipt of a copy of this order.
6 With the above direction, this Writ Petition is disposed of. No order
as to costs. Consequently, miscellaneous petitions, if any, pending in this Writ Petition, shall stand closed.
