THE HONOURABLE SRI JUSTICE M.S.RAMACHANDRA RAO WP.No.14334 of 1997 ORDER :
On 11.04.2000, this Court directed payment of batta on or before 25.04.2000 with a default clause stating that if batta is not paid within the stipulated time, the Writ Petition would stand dismissed for non-prosecution.

Since this order was not complied with, the Writ Petition stood dismissed for non-prosecution.

The petitioner then filed WPMP.No.19963 of 2000 to condone the delay of (102) days in filing the petition to set aside the order dt.11.04.2000 in WP.No.14334 of 1997, and for restoration of the said Writ Petition.

On 06.11.2000, this application was allowed subject to payment of costs of Rs.500/- to the Andhra Pradesh State Legal Services Authority within two (02) weeks. This order was complied with on payment of costs on 18.11.2000.

On 23.08.2012, this Court stated that the Writ Petition had already been dismissed for default against the 1st respondent on the basis of an endorsement dt.21.06.2000 that the Writ Petition had been dismissed for non-prosecution.

Accordingly, WPMP.No.(SR).No.159067 of 2012 was filed for condonation of the delay of (4317) days in fling the restoration petition.

The said application was allowed on 19.06.2017 subject to the petitioner paying Rs.5,000/- to the 1st respondent after service of notice on him. The counsel for petitioner was also permitted to take out notice to 1st respondent by way of Registered Post Acknowledgment Due (R.P.A.D.) and file proof of service. However, this conditional order was not complied with, and no notice to the 1st respondent has been served.

In this view of the matter, the Writ Petition is dismissed for non-prosecution. No order as to costs.

As a sequel, miscellaneous petitions pending if any in this Writ Petition, shall stand closed.
