THE HON'BLE SRI JUSTICE C.PRAVEEN KUMAR WRIT PETITION No. 21276 of 2016 ORDER :

The present Writ Petition came to be filed seeking to issue writ of mandamus declaring the action of respondent Nos.4 and 5 in calling the petitioner to police station and harassing her without there being any registration of crime against her, as illegal and arbitrary.

2. Heard the learned counsel for the petitioner and the Assistant Government Pleader for Home for the State of Andhra Pradesh appearing for the respondents. At the request of both the counsel, the Writ Petition itself is taken up for disposal at the stage of admission.

3. The case of the petitioner is that her husband by name N.Vijay Kumar was implicated in a case in crime No.94 of 2015 of Ramachandrapuram police station, East Godavari District, and after completion of investigation, police laid charge sheet against him for the offences punishable under Sections 457, 380 and 411 of the Indian Penal Code, 1860 (IPC) before the Court of the Additional Judicial Magistrate of First Class, Ramachandrapuram, which was taken on file as C.C. No.44 of 2015. It is her grievance that pending disposal of the aforesaid case, respondents 4 and 5 are frequently calling her to police station for no reason and demanding her to bring the

stolen property.

Learned Assistant Government Pleader appearing for respondents, on instructions, states that respondent Nos. 4 and 5 are not summoning the petitioner to the police station and if her attendance is required, they would follow due process of law. Recording the said statement and having regard to the fact that no crime is pending against the petitioner as on today, the respondents are directed not to summon the petitioner to police station without following due process established by law.

5. The Writ Petition is disposed of with the aforesaid direction. Miscellaneous petitions pending, if any, in the Writ Petition shall stand closed in the light of this final order. No order as to costs.
