THE HON'BLE SRI JUSTICE M.GANGA RAO WRIT PETITION No.7726 OF 2007 ORDER :

This writ petition is filed by the petitioner-Society, namely, Machavaram Primary Agricultural Co-operative Society seeking a direction to the respondents 3 and 4 not to disburse the compensation amounts to the borrowers of the petitioner-Society without obtaining 'No Objection Certificates' from the petitionersociety in pursuance of the Notification issued under Section 4 (1) of the Land Acquisition Act vide Rc.No.B/4404/06, dated 17.11.2006, Rc.No.B/4400/06, dated 18.11.2006, and Rc.No.B/4403/06, dated 17.11.2006 pertaining to Vemavaram village; Rc.No.B/4471/06, dated 17.11.2006 of Yellampalli village, Rc.No.B/4125/06, dated 30.10.2006 of Govindapuram;

Rc.No.B/4402/06, dated 17.11.2006, and Rc.No.B/4466/06, dated 21.11.2006 pertaining to Regulagadda village of Machavaram Mandal, Guntur District.

Now, the learned counsel for the petitioner-Society submits that the compensation amounts were disbursed to the borrowers whose lands are acquired as per notification issued under Section 4 (1) of the Land Acquisition Act.

The learned Assistant Government Pleader submits that the compensation amounts were paid on submission of the 'No Objection Certificate' from the petitioner-Society.

Hence, no cause of action survives in this writ petition. The writ petition is dismissed as infructuous. No order as to costs. Consequently, miscellaneous petitions pending, if any, in this writ petition, shall stand closed.
