When there was no representation for the appellant on 28.08.2017, Registry was directed to list the present appeal under the caption 'for dismissal'.

Today also, there is no representation for the appellant. The present appeal against respondent No.2 already stood dismissed for noncompliance of the direction issued by this Court on 08.02.2016. It appears, the appellant is not interested in prosecuting the present appeal. Hence, the present Civil Miscellaneous Appeal is dismissed for non-prosecution.

As a sequel, miscellaneous applications, if any pending in the instant appeal, stand closed.
