Heard the learned counsel for the petitioner. There is no representation on behalf of the second respondent. 2.

Learned counsel appearing for the petitioner brought to the notice of this Court that the petitioner paid the cheque amount to the second respondent during the pendency of the revision in this Court. Though the second respondent engaged a counsel, he is not coming forward to record the said payment and closure of the revision by compounding the offence under Section 147 of the Negotiable Instruments Act, 1881 (for short, 'the Act').

Learned counsel also brought to the notice of this Court that the Court below is not entertaining the application filed by the petitioner under Section 147 of the Act, since the pendency of the revision in this Court. Therefore, the learned counsel seeks permission of this Court to close the revision enabling him to move an application under Section 147 of the Act.

In that view of the matter, the revision is closed giving liberty to the petitioner to move an appropriate application before the trial Court for appropriate orders as per law. Till final orders are passed in the said application, no coercive steps should be taken against the petitioner. Pending miscellaneous petitions, if any, shall also stand closed. No order as to costs.
