HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 33284 of 2012 ORDER:

Heard learned counsel for the petitioner, learned Government Pleader for revenue appearing for the 2nd respondent and learned Government Pleader for agriculture appearing for respondent Nos.1, 3 and 4. With the consent of the parties, the writ petition is heard and disposed of at the admission stage itself. The present writ petition came to be filed seeking issuance of a writ of mandamus declaring the inaction of the 2nd respondent in disposing of the representation dated 16.07.2012 made by the petitioner Society as illegal and unjust, and consequently, to direct the 2nd respondent to consider and dispose of the said representation, at the earliest.

The averments made in the affidavit filed in support of the writ petition are that the petitioner Society was established in the year 1991 with small and marginal farmers in Dimili and surrounding villages of Rambilli Mandal, Visakhapatnam District. The members of the Society were eking out their livelihood by cultivation. It is averred that as the members of the Society and other farmers in the vicinity do not have facility to store paddy and other agricultural products, they are compelled to sell the same to the middlemen at a low price than the prevailing market price, thereby incurring heavy losses. In view of the same, the petitioner Society made several representations to the respondent authorities seeking construction of godowns in the agricultural market yard for purpose of storage of paddy and other agricultural products. As there was no response, the petitioner Society made another representation dated 16.07.2012 to the 2nd respondent, but till date no action has been initiated. Questioning the inaction of the 2nd respondent, the present writ petition is filed.

The main grievance of the petitioner Society is that due to lack of storage facility, the farmers are compelled to sell the paddy and other agricultural products to the middlemen at a cheaper price, thereby incurring heavy losses. Having regard to the circumstances of the case, the Writ Petition is disposed of, advising the 2nd respondent to consider and dispose of the representation dated 16.07.2012 made by the petitioner Society seeking construction of godowns for the purpose of storage of the agricultural products, if it is still pending consideration, in accordance with law, within a period of twelve (12) weeks from the date of receipt of a copy of the order. There shall be no order as to costs. Consequently, miscellaneous petitions if any pending in the writ petition shall stand dismissed.
