HON'BLE SRI JUSTICE T. VINOD KUMAR WRIT PETITION NO.26859 OF 2019 ORDER:

The present Writ Petition as filed is directed against the action of the 3rd respondent in interfering with the civil dispute and further threatening the petitioner with dire consequences as illegal, arbitrary and unconstitutional and with a consequential direction to the respondent No.3 not to interfere with the civil dispute and life and personal liberty of the petitioner.

Heard learned Counsel for the petitioner and learned Assistant Government Pleader for Home.

Learned Assistant Government Pleader for Home, on written instructions dated 09.12.2019, submits that basing on the complaint of one Salikanti Saidulu, respondent No.4 in this Writ Petition, on 17.10.2019, against Sri Venkatesham, the petitioner in this Writ Petition and his mother, a case was registered and the investigation into the complaint revealed that the named people trespassed into the complainant land and damaged boundary stones.

On completion of investigation, the charge sheet was filed and the case was numbered as C.C. No.846 of 2019 on the file of Judicial Magistrate of Ist Class, Nidamanoor and the case is pending.

Learned Assistant Government Pleader also submits that in so far as the complaint of the petitioner is concerned, the Station House Officer informed the petitioner to produce relevant documents in support of the complaint, after obtaining relevant documents from the petitioner, action would be taken as per law. In so far as the further allegation of the petitioner that the 3rd respondent is interfering with the civil dispute and further threatening the petitioner with dire consequences, the same is denied and it is stated that the 3rd respondent never interfered with the civil dispute of the petitioner at any point of time nor threatened him with dire consequences, except investigating into the complaints received.

Recording the said submission made on behalf of the 3rd respondent, no further orders are required to be passed in the Writ Petition.

Accordingly, the Writ Petition is closed. No orders as costs.

As a sequel thereto, the miscellaneous petitions pending, if any, shall stand closed.
