HONOURABLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 12595 of 2017 ORDER:

Heard the learned counsel for the petitioner, and learned Government Pleader for Prohibition and Excise. The Writ Petition is filed complaining inaction of respondent - authorities in disposing of the application of the petitioner dated 20.02.2017 for change of the proposed licensed premises.

The petitioner states that, pursuant to the notification issued by the authorities, in terms of Rule 4 of the A.P. Excise (Grant of Licence of Selling by shop and conditions of licence) Rules, 2012, he applied for issuance of bar licence initially at D.No.4-4-209, Khammam Road, Peddapalli Town and, as the members of the locality raised objection, he made an application dated 20.02.2017 for change of location to D.No.2-3-191/3, Janda Chowrasta, Peddapalli. The application has since not been considered till date, the petitioner filed the present writ petition. Learned Government Pleader for Prohibition and Excise, on instructions, submits that the process of selection has not yet been completed and, as on date, no decision has been taken. He, however, submits that the application of the petitioner would be considered in accordance with law.

Recording the submission of the learned Government Pleader for Prohibition and Excise, the Writ Petition is disposed of with a direction to the respondent - authorities to consider the application of the petitioner for change of location while taking decision for grant of 2-B licence. Miscellaneous petitions pending, if any, shall stand dismissed. No order as to costs.
