HON'BLE SRI JUSTICE U.DURGA PRASAD RAO Criminal Petition No.7132 of 2018 ORDER:

In this petition filed under Section 482 Cr.P.C., petitioners/respondents 1 to 6 seek to quash the proceedings against them in DVC.No.13 of 2018 on the file of Judicial First Class Magistrate, Miryalaguda. 2) A perusal of the complaint allegations would reveal, they are mainly aimed at describing the various atrocious acts allegedly committed by the 1st petitioner/1st respondent. Sofaras petitioners 2 to 6/respondents 2 to 6 who are parents, brothers, sister and brother-in-law of 1st petitioner/1st respondent are concerned, except an omnibus allegation against them to the effect they too harassed her, no specific allegation giving description of their atrocious acts was made.

Therefore, in the considered view of this Court, continuation of the proceedings against petitioners 2 to 6/respondents 2 to 6 would amount to abuse of process of the Court. However, as already stated supra, there is a prima facie accusation against the 1st petitioner/1st respondent. 3) In that view, this Criminal Petition is partly allowed and the proceedings against petitioners 2 to 6/respondents 2 to 6 in DVC No.13 of 2018 on the file of Judicial First Class Magistrate, Miryalaguda are quashed. However, proceedings against 1st petitioner/1st respondent shall continue. As a sequel, miscellaneous applications pending, if any, shall stand closed.
