HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.23596 OF 2018 O R D E R :
This writ petition is filed challenging the action of the 2nd respondent in interfering with the civil disputes of the petitioner by restraining the petitioner from enjoying his property bearing Survey No.244, to an extent of Ac.15.16 guntas, situated at Kistareddypet, Medak District.
Heard learned counsel for the petitioner.
Learned Assistant Government Pleader for Home produced written instructions stating that basing on the private complaint made by the 5th respondent before the Court of Additional Judicial Magistrate of First Class at Sangareddy, a case in Crime No.526/2015 was registered against the petitioner and others on the file of Patancheru Police Station of Medak District under Sections 468, 471, 420 and under Sections 120-B, 447 and 506(2) IPC, dated 16.10.2015; that later the same was transferred to the 2nd respondent Police station for investigation; that investigation is under progress; and that basing on the total out come of the investigation appropriate action will be taken against the accused including the petitioner. The other allegations that the respondent police are summoning the petitioner to the police station and making him to sit in the police station for hours together and threatening him with dire consequences, were all denied.
Recording the aforesaid submission of the learned Assistant Government Pleader, the writ petition is disposed of. However, it goes without saying that the respondent police cannot interfere with the life and liberty of the petitioner, except in accordance with law. No order as to costs.
