THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION NO.9031 OF 2003 O R D E R:
This writ petition is filed with a prayer to issue a writ, order or direction more particularly one in the nature of writ of Mandamus, declaring the action of the 2nd respondent though the reserved Schedule Tribe eligible candidates were available for the post of Junior Line Man and also without filling up and not declaring the results of the Ex-casual Labourers by the 2nd respondent and not filling the 50% left over vacancies as per B.P.Ms.No.36, dt.18.05.1997 as per their notification is illegal, improper, void and to declare the petitioner as an eligible candidate for the post of Junior Line Man and to pass such other order or orders as this Court may deem fit and proper in the circumstances of the case.
This Court while admitting the writ petition, passed the following interim orders in W.P.M.P.No.11576 of 2003, dt.30.07.2003: "Pursuant to the notification issued by the 2nd respondent calling applications for the post of Junior Line Man (Scheduled Tribe) to fill up 50% of the vacancies by way of direct recruitment, the petitioner filed application and he was also interviewed on 29.10.2002. It is stated that the said posts were reserved for Scheduled Tribe candidates and the petitioner who is S.T. candidate, along with 4 others applied, but results of the said interview were not declared. It is further stated that the qualification prescribed for the said post, as per B.P.Ms.No.36, dated 18.05.1997, is a pass in S.S.C., along with I.T.I. qualification.
Admittedly, the petitioner passed S.S.C. and possessing I.T.I. qualification and therefore, there is no justification on the part of the respondents, in withholding the results of the interview.
Having regard to the facts and circumstances, the respondents are directed to declare the results for the post of Junior Line Man as per the interview dated 29.10.2002 before which, the petitioner appeared." No counter affidavit is filed.
The learned counsel for the petitioner submits that in view of the interim orders, no further orders are necessary in this writ petition. Accordingly, the writ petition is disposed of in terms of the interim orders. Miscellaneous petitions, pending, if any shall stand closed. No order as to costs.
