THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.9651 of 2023 ORDER:

This Criminal Petition is filed under Section 438 of Cr.P.C. by the petitioners/Accused Nos.2 to 5 seeking bail in the event of their arrest in connection with Crime No.333 of 2023 on the file of Nirmal Town Police Station, Nirmal District, registered for the offences under Sections 498-A and 304-B r/w. 34 of IPC. 2.
Heard learned counsel for the petitioners and learned Assistant Public Prosecutor for the respondent-State and perused the record.

The case of the de-facto complainant, who is father of the deceased is that his deceased daughter loved and married A-1 prior to two months of her death. A-1 was already married to A-4 namely Sangeetha. In the complaint, it is mentioned that the deceased used to inform her sister that A-1 was demanding Rs.10,00,000/- towards dowry. On 03.09.2023, his daughter was taken to the hospital, thereafter, she died on the next day. He expressed suspicion that she was administered some liquid resulting in her death.

Since there are no allegations of any demand by these petitioners and the specific allegation is against A-1, this Court
deems it appropriate to grant the relief of anticipatory bail to A-2 to A-5, subject to the following conditions:
1) The petitioners/Accused Nos.2 to 5 are directed to surrender before the Station House Officer, Nirmal Town Police Station, Nirmal District, on or before 13.10.2023. On such surrender, the said Station House Officer shall release the petitioners on bail, on their executing personal bond for a sum of Rs.20,000/- (Rupees Twenty thousand only) with two sureties for a like sum each to his satisfaction.
2) On such release, petitioners/Accused Nos.2 to 5 shall appear before the concerned Station House Officer at 10.00 A.M on every Monday for a period of four weeks, for the purpose of investigation and thereafter, as and when required.
3) The petitioners/Accused Nos.2 to 5 shall abide by the other conditions stipulated in Section 438(2) of Cr.P.C and shall co-operate with the Investigating Officer in investigating the case.

Accordingly, this Criminal Petition is allowed.
Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
