G.Harish Chander v. The State Of Telangana
THE HON'BLE SRI JUSTI CE T.VI NOD KUMAR WRI T PETI TI ON No.26843 of 2019 ORDER:
This writ petition is filed to declare the action of respondents 2 to 6 in not conducting investigation by registering the crime against respondents 7 to 10 as per the complaint lodged by the petitioner on 02.08.2019, as illegal, arbitrary and violative of Articles 14, 21 and 300-A of the Constitution of India.
2.
Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for Home for official respondents 1 to 6. 3.
Learned Assistant Government Pleader for Home, on written instructions dated 02.03.2020, a copy of which along with a copy of notice dated 03.01.2020 addressed to the petitioner, is placed on record, submits that based on the complaint made by the petitioner's daughter N.Sunitha on 13.07.2019, a case was registered in Cr.No.349 of 2019 under Sections 447, 504 and 506 I.P.C by the R.G.I Police Station and is being investigated into. As the complaint made by the petitioner on 02.08.2019 disclose the same facts, a G.D. entry was made since F.I.R was already registered and a notice was sent to the petitioner through registered post on 03.01.2020 informing the petitioner that a case was registered based on the complaint of the petitioner's daughter dated 13.07.2019 and is under investigation. 4.
Though, it is vehemently opposed by the learned counsel for the petitioner that the incidents complained by the petitioner's daughter on 13.07.2019 and the petitioner on 02.08.2019 are different, having regard to the stand taken by the respondent authorities that a case has been registered in Cr.No.349 of 2019 based on the complaint of the petitioner's daughter and
is being investigated into, this Court is of the view that the respondent authorities shall record the statement of the petitioner in the said crime and while recording the statement of the petitioner also take note of the subsequent events that may be brought by the petitioner to the notice of the said authorities, including the details of other accused in the said crime, for the purpose of investigation into the matter. 5.
Subject to the above observation, the writ petition is disposed of. Pending miscellaneous petitions, if any, shall stand closed in the light of this final order. No order as to costs.
