THE HON'BLE SRI JUSTICE A. V. SESHA SAI WRIT PETITION No.9224 OF 2016 ORDER:

This Writ Petition is filed under Article 226 of the Constitution of India challenging the order passed by the 3rd respondent - Project Director, Kurnool, vide proceedings Rc.No.39/HRM/2016 dated 01.03.2016.

Heard Sri K. Rathangapani Reddy, learned counsel for the petitioner, and Sri M.S. Rama Chandra Murthy, learned Standing Counsel for the 3rd respondent.

The petitioner herein is a Field Assistant of Shabashpuram Gram Panchayat, Tuggali Mandal, Kurnool District. The 3rd respondent - Project Director by virtue of the impugned order dated 01.03.2016, placed the petitioner under suspension pending enquiry. The said order is under challenge in the writ petition. According to the learned counsel for the petitioner, the order of suspension is highly unwarranted and in the facts and circumstances of the case, it is highly arbitrary, illegal, unreasonable and in violative of Article 14 of the Constitution of India.

On the contrary, it is submitted by the learned Standing Counsel for the 3rd respondent that the impugned order is only an order of suspension pending enquiry and in the facts and circumstances of the case, the petitioner herein cannot be permitted to scuttle further proceedings. Since the petitioner is suspended pending enquiry, this Court, having regard to nature of controversy, is not inclined to meddle with the impugned action at this stage. But however this Court is of the opinion that the ends of justice would be served, if the 3rd respondent is directed to complete the enquiry within a time frame. Hence, the writ petition is disposed of, directing the 3rd

respondent to finalize the enquiry against the petitioner pursuant to the proceedings Rc.No.39/HRM/2016 dated 01.03.2016 within a period of two months from the date of receipt of a copy of this order. There shall be no order as to costs.

The Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
