This civil miscellaneous appeal is filed under Order XLIII Rule 1 of CPC challenging the order dated 04.3.2015 in I.A. No.230 of 2015 in O.S. No.39 of 2015 on the file of the Court of V Additional District Judge, East Godavari at Rajahmundry. 2.

At the time of hearing, learned counsel for the respondents submitted that the respondents are not in possession of the suit schedule property. In view of the submission made by the learned counsel for the respondents, the very purpose of filing of the civil miscellaneous appeal has become infructuous.

Hence, the civil miscellaneous appeal is dismissed as infructuous. No costs. The trial court is hereby directed to dispose of the suit as expeditiously as possible.
