THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO.9652 OF 2023 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner/Accused No.1 in Crime No.333 of 2023 on the file of Nitmal Town Police Station, Nirmal District, registered for the offences under Sections 498-A and 304-B r/w. 34 of IPC. 2.

Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the respondent-State and perused the record.

The complaint was registered on 04.09.2023 on account of the death of wife of this petitioner. The father of the deceased lodged a complaint alleging that his daughter was married to this petitioner and thereafter started living with the family who included the 1st wife of this petitioner and parents of this petitioner. The deceased while undergoing treatment in the hospital, died. The complaint states that the father of the deceased suspects that some

liquid must have been forcibly administered to the deceased, for which reason, she has died. Prima facie, the post mortem report does not reflect that there was any kind of poisonous substance in the body. However, FSL report is awaited.

Keeping in view that the only allegation made in the complaint is suspicion regarding administration of some poison and the Police have not registered any case for murder, the petitioner can be granted the relief of regular bail, subject to following conditions:

i) The petitioner/Accused No.1 shall execute personal bond for a sum of Rs.25,000/- (Rupees Twenty five thousand only) with two sureties, for a like sum each to the satisfaction of Additional Judicial First Class Magistrate, Nirmal.

ii) The petitioner/Accused No.1 after release shall appear before the concerned Station House Officer, everyday at 10:00 a.m. for a period of eight weeks, for the purpose of investigation and thereafter, as and when required.

iii) The petitioner/Accused No.1 shall abide by the other conditions stipulated under Section 437(3) of Cr.P.C.

Accordingly, this Criminal Petition is allowed.

Miscellaneous applications, pending if any, shall stand closed.
