THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.6529 of 2015 ORDER:

The grievance of the petitioner was that the police authorities had opened a rowdy sheet in his name and were continuing the same despite the single criminal case in which he was involved ending in acquittal. A consequential direction was sought to the police authorities to forthwith close the said rowdy sheet which was being maintained on the file of Kandukur Town Police Station, Prakasam District.

The Sub-Divisional Police Officer, Kandukur, Prakasam District, filed a counter-affidavit conceding that Crime No.73 of 2006 involving the petitioner ended in his acquittal in S.C.No.329 of 2007 under judgment dated 26.03.2009. He further stated that the movements of the petitioner had been thoroughly verified and it was found that there were no instances of any highhanded activities during the last few months. The Sub-Divisional Police Officer therefore stated that in the light of the present situation, it has been decided to remove the history sheet opened in the name of the petitioner and a proposal in this regard would be submitted to the Superintendent of Police for taking appropriate action. The learned Assistant Government Pleader for Home informed this Court that a review meeting would be undertaken during December, 2015 to examine cases of this nature.

In that view of the matter, the writ petition is disposed of directing the respondent police authorities to review the petitioner's case during the meeting scheduled to be held in December, 2015 and take appropriate action in the matter pursuant to what has been stated by the Sub-Divisional Police Officer, Kandukur, Prakasam District, in the counter filed before this Court. This exercise shall be completed expeditiously and in any event, not later than the end of January, 2016.

Pending miscellaneous petitions, if any, shall stand closed in the light of this final order. No order as to costs.
