THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.7799 OF 2022 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioners who are arrayed as Accused Nos.3 and 4 in Crime No.183 of 2022 pending on the file of Station House Officer, Gadwal Town Police Station, Jogulamba Gadwal registered for the offences punishable under Section 370-A(2) of Indian Penal Code and Sections 3, 4 and 5 of Immoral Traffic (Prevention) Act, 1956.

Heard learned counsel for the petitioners/Accused Nos.3 and 4 and the learned Assistant Public Prosecutor for the respondentState. Perused the record. 3.

The allegation against the petitioners is that they went to the brothel house which was being run by Accused Nos.1 and 2 and when the police raided the said premises on 07.08.2022, the petitioners were present and were arrested on the ground that they had come to the premises as customers.

Learned counsel for the petitioners submits that the police described the petitioners as customers in the remand report. 5.

Learned Assistant Public Prosecutor opposes the bail application.

In the said circumstances, since the petitioners are shown as customers in the remand report and they are in jail since 07.08.2022, the petitioners/Accused Nos.3 and 4 can be granted the relief of regular bail.

Accordingly, the Criminal Petition is allowed and the petitioners/Accused Nos.3 and 4 are granted bail subject to the following conditions:

i) The petitioners/Accused Nos.3 and 4 shall execute personal bonds for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) each with two sureties for a like sum each to the satisfaction of Additional Judicial First Class Magistrate at Gadwal Jogulamba, Gadwal Town District.

ii) The petitioners/Accused Nos.3 and 4 shall appear before the concerned Station House Officer on every Monday between 10.30 AM and 01.00 PM for a period of eight (08) weeks or until filing of charge sheet whichever is earlier.

iii) The petitioners/Accused Nos.3 and 4 shall abide by the other conditions stipulated in Section 437(3) of Cr.P.C. Miscellaneous applications, pending if any, shall stand closed. _____________ K.SURENDER, J Date: 06.09.2022 ns
