W.P.M.P.No. 19627 of 2015 For the reasons mentioned in the affidavit filed along with the application, the implead petition is ordered. Heard learned counsel for the petitioners, learned Government Pleader for Revenue appearing for the respondents 1 to 4 and the learned counsel for the impleaded respondent No.5.
The petitioners' grievance is that their names were
deleted from the revenue records by the order of respondent No.4-Tahsildar under File No. C/2020/2012, dated 8.9.2012. The petitioners preferred an appeal before the respondent No.3-Revenue Divisional Officer who, by order dated 19.12.2014, directed restoration of the petitioners' names in the revenue records. The present writ petition is filed by the petitioners claiming that the order of Revenue Divisional Officer has attained finality and is not being implemented.
The learned counsel for the respondent No.5 has submitted that against the order of Revenue Divisional Officer, the respondent No.5 has filed a revision which is pending before the Joint Collector, Medak district at Sanga Reddy.
Evidently the order of Revenue Divisional Officer is under challenge before the Joint Collector, Medak District at Sanga Reddy and therefore, the implementation of the said order would be subject to further orders to be passed by the revisional authority. Since the parties herein are also same parties in the revision before the Joint Collector and request for early disposal of the revision, I deem it appropriate to dispose of this writ petition by directing the Joint Collector, Medak district at Sanga Reddy to consider the revision filed by the respondent No.5 under Section 9 of the A.P. Records of Rights in Land and Pattedar Pass
Book Act, 1971 at an early date and dispose of the same, after hearing the parties, before the end of December, 2015.
A copy of this order be communicated to the Joint Collector, Medak district at Sanga Reddy for compliance of this order.
The writ petition is accordingly disposed of. Miscellaneous applications, if any, shall stand closed. No order as to costs.
