HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No. 9346 OF 2003 ORDER :

When the matter is taken up for hearing, it is noticed that the petitioner has challenged the orders passed by the authority under Minimum Wages Act i.e. M.W.147/01, dated 28.2.2003 and IA in MW 147/2001 wherein the authority had directed the petitioner to pay a sum of Rs.14,848/- and this Hon'ble Court was pleased to grant interim suspension of the orders passed by the authority, on 13.5.2003, subject to the condition that the petitioner shall deposit 50% of the total amount, and the petitioner has deposited the 50% of the amount, in pursuance to the interim orders passed by the Hon'ble Court and the balance amount is Rs.7424/-. 2.

This Court, having considered the submissions made by both the parties, is of the considered view that the ends of justice would be met, if the petitioner is directed to deposit the balance amount, if not already deposited. As there is grave irregularity or illegality on the part of the petitioner, the authority passed the orders under Minimum Wages Act. There are no merits and the Writ Petition is accordingly dismissed. 3.
