THE HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION NO.23615 OF 2018 ORDER:

This Writ Petition is filed to declare the inaction of the respondents in completing the departmental enquiry basing on the charge memo dated 05.06.2017 as per the guidelines issued under G.O.Ms.No.679 GAD dated 01.11.2008, as illegal and arbitrary and consequently, to direct the respondents to complete the departmental enquiry.

The petitioner is working as Multi-Purpose Health Extension Officer. Vide proceedings dated 05.06.2017, the petitioner was served with a charge memo containing two charges. The sum and substance of the allegations in the two charges is demanding money from the staff of Primary Health Centre. The petitioner filed his explanation dated 15.07.2017. Alleging continuation of disciplinary proceedings for no fault of him, the petitioner filed the present Writ Petition.

Having regard to the facts and circumstances of the case and the fact that the charge memo was drawn on 05.06.2017 and the petitioner filed his explanation on 15.07.2017, I see no justification to keep the disciplinary proceedings pending for such a long time, which is also contrary to the policy of the Government. 4.

Therefore, the first respondent is directed to dispose of the disciplinary proceedings, as expeditiously as possible, preferably within four (4) months from the date of receipt of a copy of this order. The petitioner shall co-operate for early disposal of the disciplinary proceedings.

Accordingly, the Writ Petition is disposed of. There shall be no order as to costs. Miscellaneous petitions, if any, pending shall stand closed.
