THE HONOURABLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.23545 of 2018 ORDER:

Heard learned counsel for the petitioner, learned Government Pleader for Municipal Administration and Sri Y.Rama Rao, learned Standing Counsel for HMDA, apart from perusing the material on record.

Vide Memo No.1610/Plg/SHZ/HMDA/2018, dated 23.05.2018, the Director (Planning), HMDA called upon the petitioner herein to submit explanation as to why the proposed action, under Section 23 of the Hyderabad Metropolitan Development Authority Act, 2008, should not be taken.

It is submitted by the learned counsel for the petitioner that, without considering the explanation, dated 29.06.2018, said to have been submitted by the petitioner herein, respondent authorities are proceeding further with the process of demolition of the subject structures. Having heard the learned counsel for the petitioner and the learned Standing Counsel, and, as the explanation, dated 29.06.2018, said to have been submitted by the petitioner herein, is pending consideration before the respondent authorities, this Court deems it appropriate to dispose of the Writ Petition with a direction to the respondent Nos.2 and 4 to consider the explanation, 29.06.2018, said to have been submitted by the petitioner herein, and take further action in

accordance with law. Till the said exercise attains finality, status quo, as on today, with regard to the subject structures, shall be maintained. There shall be no order as to costs. Miscellaneous petitions pending, if any, shall stand closed.
