HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.32697 OF 2016 ORDER:

This petition is filed for a writ of Mandamus declaring the action of the 2nd respondent in not pronouncing order in the Appeal No.1/2016 within one month of receipt of appeal as illegal, arbitrary and violative of Section 16(6) of Maintenance and Welfare of Parents and Senior Citizens Act, 2007 and for a consequential direction to the 2nd respondent to pronounce the orders in the said appeal within a period of ten days.

Heard both sides.

Since it is stated that the appeal filed by the petitioner on 07.06.2016 against the order dated 31.05.2016 passed by the Revenue Divisional Officer, Nizamabad is pending before the 2nd respondent, without going into the merits of the case, the 2nd respondent is directed to dispose of the appeal filed by the petitioner, in accordance with law, after issuing notice to the 3rd respondent, within a period of eight weeks from the date of receipt of a copy of this order.

With the above direction, the writ petition is disposed of. No order as to costs.

As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition shall stand closed.
