B. Simhachalam, v. The Government Of A.P. Rep By Its Principal Secretary
HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.3329 OF 2009 ORDER:
This writ petition is filed seeking to issue a writ of Mandamus declaring the inaction of the respondent No.1 in extending the term of petitioner and other committee members of Agricultural Market Committee, Tekkali at Kasibugga of Srikakulam District, even though such extension was given to all other market committees in the State as per G.O.Rt. No.143 Agriculture and Cooperation (AM-1) Department, dated 29.01.2009 as illegal and arbitrary. This Court while admitting the Writ Petition on 20.02.2009 passed an order in W.P.M.P.No.4325 of 2009, as under:
"There shall be interim direction to respondent Nos.1 and 2 to extend the term of existing body of Agricultural Market Committee, Tekkali at Kasibugga, Srikakulam District, on par with other committees in view of the orders made in G.O.Rt.No.143, dated 29.01.2009, if the petitioner made any application in this regard, as per law and pass appropriate orders within a period of three weeks from today and communicate the same to the petitioner."
By G.O.Rt.No.143, dated 29.01.2009, the life of Managing Committee was extended for a period of six months. This writ petition is of the year 2009, and the six months period from 29.01.2009 would itself get over by 29.06.2009. In that view of the matter, no further relief can be granted in this Writ Petition. Accordingly, the Writ Petition is closed. There shall be no order as to costs. As a sequel, pending miscellaneous petitions, if any, shall also stand closed.
