THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.3573 of 2017 ORDER:

This Writ Petition is filed seeking to declare the action of the second respondent - Registrar of Societies & District Registrar, Narsaraopet, Guntur District, in not receiving and recording the minutes of the meeting held on 17.02.2016 of the petitioner society, as illegal and arbitrary. It is the case of the petitioner that it is an educational society with registration No.493/2003. The committee held its meeting on 17.02.2016 and elected its Executive Committee Members. Thereafter, in a meeting held on 05.12.2016, a resolution was passed to the effect that minutes of the meeting dated 17.02.2016 shall be submitted to the second respondent. Accordingly, the minutes of the meeting were submitted in the Office of the second respondent on 02.01.2017 by paying necessary fees. So far, the second respondent did not receive and acknowledge the same.

Sri Satyam Reddy, learned Senior Counsel appearing for the petitioners, submits that the petitioner society has furnished the list of its members to the second respondent, who in turn, shall receive and acknowledge the same and take action accordingly. He also submits that as per Section 9 of the Societies Registration Act, 2001, there is obligation on the petitioner

ARR, J W.P.No.3573 of 2017 society to furnish the list of members to the second respondent and the second respondent to consider the same. Section 9 of the Societies Registration Act, 2001 reads as follows:

"Every year the society shall, within fifteen days from the date on which the General Body meeting was held furnish a list to the Registrar of societies which shall contain the names and addresses of the members of the Managing Committee and officers entrusted with the management of the affairs of the society."

From the above, it is clear that the petitioner society has to furnish the list of its members to the second respondent. It is to be noted that once the petitioner society furnished its list of members, the second respondent has to receive and acknowledge the same.

Therefore, the Writ Petition is disposed of with a direction to the second respondent to receive the list furnished by the petitioner society and acknowledge the same as per Section 9 of the Act, within a period of two weeks from the date of receipt of a copy of this order.

Consequently, Miscellaneous Petitions, if any pending in this Writ Petition, shall stand closed. No order as to costs. __________________________ A.RAJASHEKER REDDY, J 7th FEBRUARY, 2017.
