HON'BLE SRI JUSTICE SURESH KUMAR KAIT AND HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.254 of 2016 ORDER: (Oral) (Per Hon'ble Sri Justice Suresh Kumar Kait) Vide the present petition, the petitioner has challenged the order dated 15th June 2015, passed in O.A.No.5262 of 2011 by the Andhra Pradesh Administrative Tribunal, Hyderabad, whereby, the application filed under Section 19 of the Administrative Tribunals Act, 1985 has been dismissed.

It is not in dispute that after dismissal of the application filed by the petitioner, the respondents issued G.O.Ms.No.158, dated 31.12.2015, imposing the punishment of 100% cut in pension permanently and withholding of entire gratuity in full against the petitioner (now retired), as the charge is proved against him in the report in TEC No.18/2008 of the Tribunal for Disciplinary Proceedings.

It is pertinent to mention here that the present petition was filed in the month of January 2016. This Court, vide order dated 05.01.2016, granted status quo, because of the reason, the aforesaid G.O.Ms.No.158, dated 31.12.2015 was not brought to the notice of the Court. 4.

Since the G.O. mentioned above has been issued after passing of order by the Tribunal, we find no ground to interfere with the order passed by the Tribunal. However, liberty is granted to the petitioner to

SKK, J & AKS, J W.P.No.254 of 2016 challenge G.O.Ms.No.158, dated 31.12.2015, before appropriate forum, as per law.

Writ petition is accordingly dismissed. No order as to costs. As a sequel, all the pending miscellaneous applications shall stand closed.
