HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.43327 OF 2016 ORDER:

The case of the petitioner is that the 3rd respondent issued impugned proceedings dated 19.09.2016 cancelling the fair price shop authorization of the petitioner. Against the same the petitioner preferred appeal before the 2nd respondent along with stay petition on 19.10.2016, but no orders are passed in the same. Aggrieved by the same, present writ petition is filed. Heard learned counsel for the petitioner who states that though the variations are very meagre and within permissible limits, the appellate authority has not passed any orders in the stay petition filed by the petitioner along with statutory appeal. Heard learned Assistant Government Pleader for Civil Supplies.

In view of the aforesaid facts and circumstances, the 2nd respondent is directed to dispose of the appeal filed by the petitioner within a period of eight weeks from the date of receipt of a copy of this order. Till the disposal of the appeal, the impugned order is suspended.

Accordingly, the writ petition is disposed of. No order as to costs.

As a sequel thereto, miscellaneous applications, if any, pending, shall stand closed.
