This writ petition is filed aggrieved by the action of respondents 2 and 3 in reprocessing the application of respondent No.4 for grant of affiliation, though it was rejected vide order dated 17-04-2018 for want of valid registered existing lease deed for academic year 2018-19 to run the college of respondent No.5 in the premises of H.No.23-6-140/1, 2 and 3, Hunter Road, Hanmakonda, Warangal.
After hearing the matter at length by the counsel for the petitioner and Sri Vedula Srinivas, learned counsel for respondents 4 and 5, they have stated that the parties have come to an understanding that they will withdraw the suits i.e. O.S.No.569 of 2017 filed for permanent injunction and O.S.No.153 of 2017 filed for eviction before the II Additional Senior Civil Judge and Principal District Judge, Warangal by respondent No.4 and petitioner respectively and filed memos stating that respondent No.4 will vacate the premises at the end of academic year 2018-19, but will agitate their rights regarding rents payable or already paid separately. Heard Sri D.L.Pandu, learned counsel appearing for respondents 2 and 3.
Learned counsel for respondents 4 and 5 submits that he has paid amount in excess of the rent. Learned counsel for the petitioner says that he is entitled for more rents due from
respondents 4 and 5. The said aspects can be agitated before the concerned civil Court separately.
By recording the above undertaking by way of memos dated 27-07-2018, 26-07-2018 and 08-08-2018 filed by writ petitioner and respondents 4 and 5 respectively, this writ petition is disposed of and as a consequence, the official respondents shall not grant affiliation to respondents 4 and 5 in respect of the subject premises for the next academic year i.e. 2019-20 and accordingly respondents 4 and 5 have to vacate the subject premises on or before 30-04-2019.
