HONOURABLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No. 16215 of 2015., ORDER:

Heard learned counsel for the petitioner and learned Government Pleader for respondents.

The petitioner is the owner of Auto Trolley bearing registration No. AP 20 TC 2056 and he was using the said vehicle for loading and unloading business on hire basis. While so, on 06.04.2015 when the petitioner was transporting the rice from Khammam to Malangpally village, Dornakal Mandal, Warangal District, the said vehicle was intercepted by the third respondent and seized the same. Later on 6-A proceedings were initiated and the vehicle was produced before the competent authority. The petitioner filed an application before the second respondent on 25.04.2015 seeking release of the said auto trolley on furnishing bank guarantee to the cost of the seized stock and when the said vehicle was not released, the present Writ Petition is filed.

Since the vehicle of the petitioner is involved in the seizure and 6-A proceedings are initiated, this Court is not inclined to pass orders for release of the vehicle on furnishing the bank guarantee to the cost of the stock seized thereon. In view thereof, since the petitioner had already filed an application before the second respondent seeking release of the vehicle, the second respondent shall pass orders within one week from the date of receipt of a copy of this order, incorporating usual conditions, if any. The Writ Petition is accordingly disposed of. Miscellaneous petitions pending consideration if any in this writ petition shall stand closed in consequence.. No order as to costs.
