HON'BLE SRI JUSTICE S.V. BHATT W.P. No.23564 OF 2018 ORDER:

Heard Mr.P.Vishnuvardhan Reddy for petitioner and the learned Assistant Government Pleader for respondents. The petitioner challenges the order dated 02.04.2018 as illegal, violative of principles of natural justice and not conforming to the requirements of Section 133 of Criminal Procedure Code. The respondents have produced the record for inspection of the Court.

I have perused the record and prima facie I am satisfied that the first and foremost grievance of petitioner namely, order impugned in the writ petition is passed in violation of principles of natural justice and without giving reasonable time to petitioner for filing explanation, is tenable and accepted.

Hence, the petitioner is given one week time from today to submit explanation to the notice dated 17.03.2018 by enclosing a copy of this order. The 4th respondent considers each one of the objections and passes order, if necessary, after conducing enquiry within one week thereafter. For a period of two weeks, the parties are directed to maintain status quo as on date. The writ petition is disposed of accordingly. No order as to costs.
