2019-12-04T.Vinod Kumar2 pages

THE HON'BLE SRI JUSTI CE T.VI NOD KUMAR WRI T PETI TI ON Nos.26865 and 26870 of 2019 COMMON ORDER:

Since the issue in these writ petitions is one and the same, they are being disposed of by this common order.

2.

These writ petitions are filed to declare the action of the fourth respondent in these writ petitions in issuing notices, dated 29.11.2019, and also not considering the explanation offered by the petitioners, on 02.12.2019, as illegal and arbitrary.

3.

The main grievance of the petitioners in these writ petitions is that the petitioners were issued notices under Section 114 of the Telangana Gram Panchayat Act, 2014 (for short, 'the Act'), and were called upon to submit their explanations within three days. In pursuance of the said notices issued, the petitioners filed their interim replies 02.12.2019 and sought for further fifteen days time to produce the necessary documents. It is claimed in the writ petitions that despite filing their replies on 02.12.2019, the respondent authorities are threatening to demolish the petitioners' houses in respect of which the impugned notices have been issued.

4.

Sri G.Narender Reddy, learned standing counsel for the Gram Panchayat, submits that in response to the request made by the petitioners on 02.12.2019 for grant of further time, the respondent authorities have issued notices on 03.12.2019 extending the time by five days to enable the petitioners to submit their replies thereto. Learned standing counsel would further submit that since the petitioners failed to receive the said notices, copies of the same were affixed to the

petitioners' house. Further, copies of the said notices are also being furnished to the learned counsel for the petitioners today in the Court. 5.

In the light of the submissions made on behalf of the Gram Panchayat by the learned standing counsel and considering the fact that the petitioners are only purchasers of plots, which were stated to have been made in the layout developed by some third parties, this Court is of the view that the request of the petitioners for grant of further time can be considered and accordingly, the petitioners are directed to file their objections along with necessary documents before the authority concerned on or before 16.12.2019. Upon such filing of the explanations by the petitioners, the respondent authorities shall consider the same and act in accordance with the provisions of the Act. 6.

With the above directions, the writ petitions are disposed of. Pending miscellaneous petitions, if any, shall stand closed in the light of this final order. No order as to costs.
