This appeal is preferred questioning order dated 07-09-2009 in I.A.No.719/2008 in O.S.No.90/2009 on the file of IV Additional District Judge, Visakhapatnam.

This appeal is preferred by defendant against whom an injunction was granted in the above referred I.A., and this I.A and I.A.No.1258/2008 in O.S.No.301/2008 were disposed of by a common order and as per the submission of both sides, suit in O.S.No.90/2009 was decreed in favour of plaintiff on 25-01-2016 and in view of the decree passed in favour of plaintiff, the

relief claimed in this appeal has become infructuous.

3. Considering the submissions of both sides, appeal is dismissed as infructuous. No costs.

As a sequel, miscellaneous petitions, if any, pending in this appeal, shall stand dismissed.
