THE HON'BLE SRI JUSTICE P. KESHAVA RAO WRIT PETITION No.1299 of 2015 ORDER:

There is no representation for the petitioner in spite of listing the matter under the caption "for dismissal". As a matter of fact, on 30.09.2019 also there was no representation on behalf of the petitioner.

The prayer sought for in the Writ Petition is as under: "to issue a Writ or Direction more in the nature of Writ of Mandamus declaring the inaction of the respondents as illegal, untenable, arbitrary against the public policy and the natural justice and consequently direct 1st and 2nd respondents to get the investigation by lady officers and bring the crimes committed by Constable Mr.Somi Reddy to book, otherwise the petitioner shall suffer irreparable hardship, damages and loss that cannot be compensated by any means." 3.

Learned Assistant Government Pleader for Home appearing for respondents placed on record the written instructions, dated 03.02.2015 issued by the Sub Inspector of Police, Kushaiguda Police Station, Cyberabad Commissionerate. From the perusal of the said written instructions, it is evident that on receipt of communication about filing of the writ petition by the petitioner, the 2nd respondent thoroughly verified the records in the office including the General Diary as to whether any complaint was received from the petitioner to initiate action against Sri Somi Reddy, Constable/Writer. However, no compliant of whatsoever is received from the petitioner to initiate action against the said Somi Reddy. The records verified further revealed that on the compliant of the petitioner lodged with Kushaiguda Police Station, a case in Crime No.393 of 2012 under

Section 498-A IPC and Section 4 of the Dowry Prohibition Act, 1881 was registered on 10.06.2012 against her husband Sri Vaseem and investigation was taken up. Except the above said complaint, no other complaint was received from the petitioner to take action against the said Somi Reddy.

In that view of the matter, this Court is of the opinion that there are no merits in the writ petition and the same is liable to be dismissed.

Accordingly, the Writ Petition is dismissed. Miscellaneous petitions, if any, pending in this writ petition shall stand closed. There shall be no order as to costs.
