HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No. 6333 of 2003 ORDER:

1.

When this matter is taken up for hearing, the learned Counsel for the petitioner submits that the petitioner challenged the order of his removal from service before the labour Court by filing I.D.No.97 of 1999 and the Labour Court dismissed the said I.D. vide order dated 3.8.2002 and challenging the same, the present writ petition is filed. The learned Counsel for the petitioner further submits that appropriate orders may be passed directing the respondent-Corporation to reinstate the petitioner into service.

2.

Having considered the above submissions, this Court is of the view that the relief sought by the petitioner, at this point of time, may not be possible as the petitioner is on the verge of retirement. However, a direction can be issued to the respondent-Corporation to pay the service benefits of the petitioner for the services rendered by him prior to his removal. 3.

Accordingly, the Writ Petition is disposed of directing the respondent-Corporation to pay the service benefits of the petitioner for the services rendered by him prior to his removal, if not already paid, within a period of four weeks from the date

of receipt of a copy of this order. No costs. Consequently, miscellaneous petitions pending, if any, shall stand closed. ___________________________ ABHINAND KUMAR SHAVILI, J 15th December, 2018 Nn
