THE HON'BLE SRI JUSTI CE SANJAY KUMAR AND THE HON'BLE SRI JUSTI CE M.GANGA RAO WRI T PETI TI ON NO.23867 OF 2018 ORDER: (per SK,J) The petitioner is the applicant in O.A.No.3986 of 2014 on the file of the Andhra Pradesh Administrative Tribunal, Hyderabad. The said O.A. was dismissed for default vide order dated 26.10.2016. M.A.No.84 of 2017 was thereupon filed by the petitioner-applicant seeking restoration of the said O.A. However, by order dated 25.10.2017, the Tribunal dismissed the M.A.

We are now informed that a similar situation fell for consideration before this Court in TENNETI SUJATHA V/ s. STATE OF ANDHRA PRADESH1. This Court allowed the writ petition setting aside the dismissal order passed in the O.A. and the dismissal order passed in the M.A. filed for restoration thereof and remanded the matter to the Tribunal for consideration afresh.

For reasons alike as were stated in the aforestated order and in terms thereof, this writ petition is allowed setting aside the order dated 25.10.2017 passed in M.A.No.84 of 2017 in O.A.No.3986 of 2014 and the order dated 26.10.2016 passed in O.A.No.3986 of 2014 on the file of the Andhra Pradesh Administrative Tribunal, Hyderabad. The O.A. shall stand restored to the file of the Tribunal for consideration afresh on its own merits and in accordance with law.
