R.Gopal Naidu v. Andhra Pradesh State Road Transport Corporation
THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.11147 OF 2013 ORDER:
This writ petition is filed under Article 226 of the Constitution of India seeking to issue an order or direction more particularly, in the nature of writ of mandamus to declare the action of the respondents in issuing the proceedings bearing No.T2/122(40)/2009-RM(T), dated 8.3.2013, as illegal and arbitrary and consequently, to set aside the same and direct the respondents to continue the petitioner as licensee of General Stores at Open Stall, Shop No.33 of V.Kota, A.P.S.R.T.C. Bus Station, Chittoor District and to run the said shop. 2.
Heard and perused the record.
3.
On 15.4.2013, this Court granted interim stay of further proceedings pursuant to the impugned proceedings, dated 8.3.2013. It is evident from the record that the license of the petitioner's shop is valid up to 24.6.2014 and the same has already elapsed. Hence, this Court is of the view that nothing survives for adjudication in this writ petition and therefore, the Writ Petition is liable to be disposed of as infructuous.
4.
Accordingly, the Writ Petition is disposed of as infructuous. There shall be no order as to costs.
5.
Miscellaneous Petitions pending, if any, in this Writ Petition shall stand closed.
