THE HON'BLE SRI JUSTICE VILAS V.AFZULPURKAR W.P.No.40234 OF 2015 O R D E R :
The petitioner has approached this Court earlier in W.P.No.25665 of 2015 questioning No Objection certificate sought for from him by the 4th respondent to enable him to alienate and register the document of sale relating to his land admeasuring Ac.5-00 cents in Sy.No.56-2 situated at Akkampet Village, Tada Mandal, SPSR Nellore District. The said writ petition was heard and disposed of on 14-082015 permitting the petitioner to make appropriate application to the 2nd respondent in terms of G.O.Ms.No.307, dated 06-06-2013 and the 2nd respondent was requested to pass appropriate orders expeditiously, keeping in view that the petitioner is 73 years old. Accordingly, the petitioner made application on 04-09-2015 and stated to have submitted all necessary documents along with the application. Learned counsel for the petitioner states that since the petitioner is 73 years old and admitted in Hospital and since almost more than three months have passed, the 2nd respondent has not taken up and disposed of the application expeditiously.
Heard the learned Government Pleader for Revenue. Keeping in view the facts and circumstances of the case and a request is already made by this Court to the 2nd respondent in the earlier writ petition, it is appropriate to direct the 2nd respondent to examine the petitioner's application on the basis of the relevant documents and reports, if any, from the subordinate officers and take appropriate decision and communicate the same to the petitioner expeditiously preferably within four weeks from the date of receipt of a copy of this order.
Accordingly, the writ petition is disposed of. No costs Miscellaneous petitions, if any, pending in the writ petition shall
stand closed.
