THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.9662 of 2023 ORDER:

This Criminal Petition is filed under Section 438 of Cr.P.C. by the petitioners/Accused Nos.5 and 6 seeking bail in the event of their arrest in connection with Crime No.24 of 2023 on the file of Vemulapally Police Station, Nalgonda District, registered for the offences under Sections 306 and 323 r/w. 34 of IPC. 2.

Heard learned counsel for the petitioners and learned Assistant Public Prosecutor for the respondent-State and perused the record.

The complaint was lodged on 06.03.2023 alleging that there were disputes in between the de-facto complainant's husband and family members in respect of rice mill. The allegation against these petitioners is that both of these petitioners who are village elders went along with A-1 and others to the house of the deceased and there was an altercation in the said house. Thereafter, the deceased committed suicide.

Since the complaint was lodged by the wife of the deceased, who was not present on the day when the incident happened and there are no specific allegations against these petitioners except that these petitioners went along with other accused, anticipatory

bail can be granted to the petitioners, subject to the following conditions:

1) The petitioners/Accused Nos.5 and 6 are directed to surrender before the Station House Officer, Vemulapally Police Station, Nalgonda District, on or before 13.10.2023. On such surrender, the said Station House Officer shall release the petitioners on bail, on their executing personal bond for a sum of Rs.25,000/- (Rupees Twenty five thousand only) with two sureties for a like sum each to his satisfaction.

2) On such release, petitioners/Accused Nos.5 and 6 shall appear before the concerned Station House Officer at 10.00 A.M on every Monday for a period of four weeks, for the purpose of investigation and thereafter, as and when required.

3) The petitioners/Accused Nos.5 and 6 shall abide by the other conditions stipulated in Section 438(2) of Cr.P.C and shall co-operate with the Investigating Officer in investigating the case.

Accordingly, this Criminal Petition is allowed.

Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
