HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 36851 of 2015 ORDER:
Heard learned counsel for the petitioners and Government Pleader for Revenue. With the consent of both the parties, the main writ petition is heard at the admission stage itself.
The present writ petition came to be filed seeking issuance of writ of mandamus declaring the inaction of the respondents in allotting government assessed waste lands in Sy.Nos. 676/3, 680/2, 676/2, 676/1, 674, 677, 678 and 679 admeasuring Ac.2.00, Ac.3.21, Ac.3.24, Ac.5.24, Ac.7.08, Ac.3.84, Ac.5.90 and Ac.4.92 respectively, situated at Velagacherla Village, Penagaluru Mandal, Kadapa District, by ordering an enquiry regarding tampering of records in respect of the above mentioned lands.
The averments in the affidavit filed in support of the writ petition would show that large extent of government land in Velagacherla Village, Penagaluru Mandal, is being occupied by different persons and the concerned officers instead of taking severe action against such persons and taking steps to protect the Government Land for the purpose of granting pattas to the eligible landless poor persons like the petitioners, are acting as silent spectators. It is alleged that taking advantage of the same, respondent No.4 and his family members are enjoying government land by claiming ownership over the same. In view of the above, the petitioners herein made representations dated 31.08.2015 and 14.10.2015 to consider their grievance and to allot land as they are landless poor persons. Inaction of respondent Nos.1 to 3, lead to filing of the present writ petition.
Though various grounds are raised in the writ petition, the learned counsel for the petitioners restricts his prayer seeking a direction to respondent No.2 to consider the representation dated 14.10.2015 made by the petitioners at the earliest. The Government Pleader for Revenue submits that such a direction may be given provided the same is still pending consideration. Without going into the merits of the case and having regard to the
circumstances of the case, the writ petition is disposed of directing respondent No.2 to consider the representation dated 14.10.2015 made by the petitioners, after giving notice to the petitioners and respondent No.4 and pass orders in accordance with law within a period of twelve (12) weeks from the date of receipt of a copy of the said order, if the same is still pending.
No order as to costs. Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
