Gummadi Bhaskar Rao, S/O Subba Rao, v. The State Of Andhra Pradesh
IN THE HIGH COURT OF JUDICATURE AT HYDERABAD
FOR THE STATE OF TELANGANA & THE STATE OF ANDHRA PRADESH * * * WRIT PETITION No. 39063 of 2015 BETWEEN Gummadi Bhaskar Rao ... PETITIONER AND The State of Andhra Pradesh, rep. by its Principal Secretary and others ...RESPONDENTS Date of Order pronounced: 02.12.2015 THE HON'BLE SRI JUSTICE VILAS V. AFZULPURKAR
1. Whether Reporters of Local newspapers Yes/No may be allowed to see the Judgments?
2. Whether the copies of judgment may be Yes/No marked to Law Reporters/Journals?
3. Whether his Lordship wish to see the Yes/No fair copy of the Judgment?
ORDER:
Heard.
2. Since all the three petitioners have been given separate notices under Rule 3 of the A.P.Assigned Lands (Prohibition of Transfer) Rules, 2007, a single writ petition cannot be maintained. Mr.Subba Reddy, learned Senior Counsel appearing for the petitioners fairly states that he confines the writ petition to the extent of petitioner No.1. Writ petition is entertained for petitioner No.1 and dismissed as against petitioner Nos.2 and 3 with a liberty to file separate writ petition, if they are so aggrieved.
3. Petitioner was given the notice alleging that he had purchased assigned lands and the petitioner had already given his reply to the said notice on 17.10.2015. It is stated that no orders have been passed in pursuance of the notice even after the reply was filed by the petitioner.
4. Since the petitioner now apprehends that he will be dispossessed, it is appropriate to direct respondent No.3 to fix a date for hearing, hear the petitioner, examine the record as well as the explanation of the petitioner, and then pass a reasoned order. Till such appropriate order is passed and for a period of two weeks thereafter, if an adverse order is passed against the petitioner, he shall not be dispossessed or otherwise interfere with his possession.
With the above direction, the writ petition is disposed of. As a sequel the miscellaneous applications, if any, shall stand closed. There shall be no order as to costs.
