This writ petition is filed to declare the action of respondents in not promoting the petitioner to the post of UDC as illegal, arbitrary and unjust and direct the respondents to promote the petitioner to the post of UDC.

This court passed interim order on 15-9-2003 directing the respondents to consider the case of the petitioner for promotion if he is otherwise eligible and qualified.

It is represented that the petitioner was subsequently promoted on 25-9-2003 i.e., within 13 days after passing of the interim order, in view of the promotion given to the petitioner, nothing survives and this writ petition has become infructuous.

Considering the same, this writ petition is dismissed as infructuous. No costs.
