It is submitted by learned counsel for the appellants that pending appeal, appellant No.1 passed away. A memo enclosing the letter, dated 08.04.2017, of appellant No.2 is filed before this Court seeking permission to withdraw the appeal in respect of appellant No.2. Therefore, to the extent of appellant No.1, the appeal is dismissed as abated and to the extent of appellant No.2, the appeal is dismissed as withdrawn.

In the result, the Appeal Suit is dismissed. There shall be no order as to costs.

Miscellaneous petitions pending, if any, in this Appeal Suit shall stand closed.
