THE HONOURABLE SRI JUSTICE M.S.RAMACHANDRA RAO WP.No.25542 of 2016 ORDER :

Heard the counsel for petitioner, and the learned Government Pleader for Home (Andhra Pradesh) for respondent nos.1 to 3.

2. It is not disputed that 4th respondent had lodged a complaint bearing FIR.No.131 of 2015 before 3rd respondent alleging that petitioner had forged certain documents and sold the 4th respondent's property to a third party.

The petitioner's grievance is that respondent nos.2 and 3 are coercing the petitioner to settle the dispute with respondent nos.4 and 5 in respect of certain property.

The learned Government Pleader for Home (Andhra Pradesh) assures that respondent nos.2 and 3 will not coerce the petitioner to settle the dispute with respondent nos.4 and 5 and that they would conduct investigation strictly in accordance with the provisions of the Criminal Procedure Code.

5. The counsel for petitioner assures that petitioner will co-operate in all respects with the smooth conduct of

investigation by respondent nos.2 and 3.

Therefore, the Writ Petition is disposed of directing respondent nos.2 and 3 to conduct investigation in FIR.No.131 of 2015 on the file of 3rd respondent strictly in accordance with the provisions of Criminal Procedure Code and file a final report in the competent Court. If they wish to interrogate the petitioner they shall issue notice under Section 41-A of the Criminal Procedure Code to petitioner.

Accordingly, the Writ Petition is disposed of with the above directions. No order as to costs.
