HON'BLE SRI JUSTICE U.DURGA PRASAD RAO CRIMINAL PETITION No.7130 of 2018 ORDER:

In this petition filed under Section 482 Cr.P.C, the petitioners/accused seek to quash the proceedings against them in Crime No.107/2018 of Lallaguda PS, registered against them for the offences under Sections 323, 342 and 506 IPC. 2) Investigation is reported to be pending.

3) When the matter came up for hearing, learned counsel for petitioners without insisting for quashment, would request that the protection as envisaged under Section 41-A Cr.P.C may be extended to the petitioners and they are ready to cooperate with the investigating agency for smooth completion of investigation. 4) In view of the said submission of learned counsel for petitioners, the Investigating Officer is directed to scrupulously follow the guidelines rendered by the Hon'ble Apex Court in the decision reported in Arnesh Kumar vs. State of Bihar1 and also the procedure contemplated under Section 41-A Cr.P.C during the course of investigation towards the petitioners/accused.

In turn, the petitioners/accused shall cooperate with the investigating agency for smooth completion of investigation.

5) Accordingly, this Criminal Petition is disposed of. As a sequel, miscellaneous petitions pending, if any, shall stand closed.
