THE HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.9698 of 2012 ORDER:
Heard Mr. G.V. Shivaji for petitioners and Mr. V. Raghu for the fourth respondent.
2. Petitioners pray for sanction for subsidy in terms of Proceedings No.M4/77/2008 dated 19.12.2008 of the third respondent.
3. The writ petition was filed on 03.04.2012. For whatever reasons, the petitioners were not successful in obtaining interim orders from this Court. Having realized the difficulty in persuading this Court to consider the writ prayer, learned counsel, Mr. G.V. Shivaji, requests the Court to permit the petitioners to apply for sanction of loan or subsidy under SC sub-plan and the third respondent may be directed to consider and pass appropriate orders.
4. The status or entitlement of petitioners otherwise is not in dispute. This Court, having regard to the lapse of time from 2008 till date, considers it appropriate to dispose of the writ petition by this order.
5. Petitioners are given liberty to make a representation to the third respondent praying for sanction of loan/subsidy, as the case may be, under existing schemes and the third respondent is directed to consider the representation and pass an order in accordance with the extant government orders. It is needless to observe that these plans are implemented on yearto-year basis and the third respondent without loss of further time considers passing orders expeditiously.
The writ petition is disposed of. As a sequel, the miscellaneous applications, if any pending, shall stand closed. There shall be no order as to costs.
