THE HON'BLE SRI JUSTICE M.SEETHARAMA MURTI CRIMINAL PETITION No.7339 of 2015 ORDER:- This Criminal Petition, under Section 482 of Cr.P.C., is filed by the petitioners/accused Nos.2 to 4, requesting to quash the proceedings in C.C.No.112 of 2015 on the file of the Judicial Magistrate of First Class, Peddapally, Karimnagar District, registered for the offences punishable under Sections 498-A IPC & Sections 3 and 4 of the Dowry Prohibition Act.

I have heard the learned counsel for the petitioners/accused Nos. 2 to 4 and the learned Public Prosecutor appearing for the State. I have perused the material record.

As rightly pointed out by the learned counsel for the petitioners herein/accused Nos.2 to 4, the names of petitioners/accused Nos.2 to 4 were deleted after investigation. However, the trial Court, by orders dated 07.03.2015, had taken the case against all the accused and directed issuance of summons to petitioners herein/accused Nos.2 to 4.

Having regard to the submissions of the learned counsel for the petitioners/accused Nos.2 to 4, this Court is of the well-considered view that though a case is not made out for quashing the proceedings, it is a fit case to dispense with the appearance of accused Nos.2 to 4 in C.C.No.112 of 2015 on the file of the Judicial Magistrate of First Class, Peddapally, Karimnagar District, as such a course would sub-serve the ends of justice.

Accordingly, the appearance of the petitioners/accused Nos.2 to 4 before the Court of the Judicial Magistrate of First Class, Peddapally,

Karimnagar District, in C.C.No.112 of 2015 is dispensed with, if their presence is not otherwise required before the Court below. This criminal petition is disposed of accordingly.
