THE HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO Writ Petition Nos.17854 and 17799 of 2015 COMMON ORDER:
Heard the learned counsel for the petitioners and the learned Government Pleader for the respondents.
With the consent of both the parties appearing before this Court, both the writ petitions are being disposed of by this common order. The petitioners are claiming to be owners of small extents of lands in various survey numbers situated at Pedakapavaram Village, Akiveedu Mandal, West Godavari District. They applied to the District Level Committee in terms of G.O.Ms.No.7, dated 16.03.2013 for conversion of agricultural land into nonagricultural purpose viz., for aquaculture purpose and they were issued a provisional registration on 10.06.2015 for construction of fresh water aquaculture ponds/fish tanks. Their application for final registration is pending. The respondents 6 & 7 are interfering with their aquaculture activities. Aggrieved by the same, these writ petitions are filed.
In view of the existence of provisional registration granted by the competent authority-third respondent, the respondents 6 & 7 cannot interfere with the activity being taken up by the petitioners so long as the provisional registration is valid and is in force. However, the third respondent is directed to consider the objections filed by the respondents 6 & 7 if any, while granting final registration which may be done, within three months from the date of receipt a copy of this order. With the above direction, these writ petitions are disposed of. Miscellaneous Petitions, if any, pending in these writ petitions shall stand closed. There shall be no order as to costs.
